Counterinh howhantanozas's government work rationale, even the government is not obliged to force the creators to waive their moral rights to them. And assume the government owns this bldg even the moral rights, in spite of saying "no copyright shall subsist......", a provision on the RA8293 limits everyone's ability to use government works: "CHAPTER VIII. LIMITATIONS ON COPYRIGHT SEC. 184. Limitations on Copyright. - 184.1. Notwithstanding the provisions of Chapter V, the following acts shall not constitute infringement of copyright: .... (h) The use made of a work by or under the direction or control of the Government, by the National Library or by educational, scientific or professional institutions where such use is in the public interest and is compatible with fair use; ...." Wikimedia commons passes public interest but it doesnt accept fair use as jeff g one of your moderators said at village pump before. So howhantanazos' government works rationale is invalid. Delete buildings and other FOP-reliant objects are mostly commissioned works, and per Sec. 178.4 of the copyright law (COM:Philippines#Commissioned works), "the person who so commissioned the work shall have ownership of the work, but the copyright thereto shall remain with the creator, unless there is a written stipulation to the contrary." This means, the Provincial Government of Sultan Kudarat owns the building physically, but copyright still remains with the architect. A good basis is that there are no other building by different architectural entity anywhere in the country with an architectural design 100% identical to the provincial capitol.
